Legal Expertise in Arbitration

Arbitration, as a form of alternative dispute resolution, offers parties a structured and efficient mechanism to resolve disputes outside traditional courts while ensuring fairness and neutrality in proceedings. Governed by the Arbitration Act, it lays down statutory provisions for initiating and conducting arbitration, including the appointment of arbitrators, adherence to timelines, and observance of due process. At the same time, Arbitration Law provides remedies through court intervention for enforcement of awards, interim reliefs, and challenges to arbitral decisions, thereby striking a balance between the autonomy of arbitration and judicial oversight. 

ARBITRATION LAW

Arbitration Agreement

  • Arbitration Proceedings in India is governed by the Arbitration and Conciliation Act, 1996 (as amended). Arbitration is an alternative dispute resolution mechanism where parties submit disputes to a neutral arbitrator instead of going to court. Awards passed by arbitrators have the same binding effect as a court decree.
  • Arbitration Agreement: Disputes can be referred to arbitration only if there is a valid arbitration agreement (clause in contract or separate agreement). Agreement must be in writing and signed by the parties.

Invocation of Arbitration and Appointment of Arbitrator

  • Invocation of Arbitration: When a dispute arises, one party issues a notice of arbitration to the other, invoking the arbitration clause. The notice specifies the dispute, claims, and appointment of arbitrator(s). 
  • Appointment of Arbitrator(s): Parties may mutually appoint a sole arbitrator or a panel. If parties fail to agree, the appointment can be made by the High Court or Supreme Court under Section 11 of the Act.

Preliminary Hearing, Evidence and Argument

  • Preliminary Hearing: Arbitrator sets out the procedure, timelines, and scope of arbitration. Parties submit statements of claim and defense.
  • Evidence & Arguments: Parties present documents, witnesses, and oral arguments. Arbitrator ensures fair opportunity to both sides.

Interim Measures

  • Interim Measures: Arbitrator or court may grant interim reliefs (e.g., injunctions, preservation of property, securing amounts in dispute). 
  • Interim Reliefs includes injunctions to restrain actions, preservation or custody of disputed property, and securing amounts in dispute 

Final Arbitral Award

  • Arbitral Award: Arbitrator delivers a written award, stating reasons and remedies. Award is binding on parties and enforceable as a court decree.
  • Final Remedies (Arbitral Award) includes monetary compensation, specific performance of contractual obligations, and declaratory reliefs.

Challenge to Award

  • Challenge to Award: Parties may challenge the award under Section 34 of the Act before a competent court on limited grounds (fraud, bias, violation of natural justice, invalid agreement).

Enforcement of Award

  • Enforcement of Award: Under Section 36, arbitral awards are enforceable like a civil court decree once the time for challenge has expired or the challenge is rejected.

Speedy and Confidential resolution

  • Arbitration offers a speedy and confidential resolution compared to traditional litigation. Awards are binding and enforceable in the same manner as court judgments. Parties retain flexibility in choosing arbitrators and procedures. Remedies include injunctions, damages, specific performance, and declaratory reliefs
